iRE, LLC, a limited liability company doing business as Apex Property Management ("iRE," "Apex," "Apex PMT," "we," "us," or "our"), respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit apexpmt.com and any related subdomains, pages, and online services (collectively, the "Site"), when you inquire about or apply for a rental, when you become a resident, property owner, or vendor, and when you otherwise interact with us.

iRE, LLC is a Washington-licensed real estate firm (WA DOL RE#: 20445) that provides residential and commercial property management, leasing, and related services under the Apex Property Management name in Spokane County, Washington and Kootenai County, Idaho, and surrounding areas, and conducts business in Idaho in accordance with applicable Idaho law. This Policy is written for the laws of Washington and Idaho, the two states in which we operate.

By using the Site or providing information to us, you acknowledge that you have read and understood this Privacy Policy.

1. Scope

This Policy applies to information we collect from and about:

  • Site visitors who browse apexpmt.com;
  • Prospective residents and applicants who inquire about, tour, or apply for a rental home;
  • Residents and tenants during and after a tenancy;
  • Property owners and prospective owner-clients who use or evaluate our management services; and
  • Vendors, contractors, and business contacts.

This Policy does not apply to the privacy practices of third parties we do not control, including property owners, listing platforms, payment processors, or tenant-screening companies, each of which maintains its own privacy practices.

2. Information We Collect

Depending on how you interact with us, we may collect the following categories of information:

  • Identifiers and contact information — name, mailing address, email address, telephone number, and, for applicants and residents, date of birth, Social Security number or other government identifiers, and driver's license or state ID number.
  • Application, tenancy, and financial information — rental and residential history, employment and income information, banking or payment information, proof of income, references, and information contained in leases and management agreements.
  • Consumer report / screening information — credit history, rental history, eviction history, and criminal background information obtained through a consumer reporting agency in connection with a rental application, in accordance with the federal Fair Credit Reporting Act (FCRA) and applicable state law.
  • Commercial information — properties and listings you view, inquiries you submit, applications you complete, and services you request.
  • Internet and device activity — IP address, browser type, device identifiers, pages viewed, referring URLs, and interactions with the Site, collected through cookies and similar technologies (see Section 5).
  • Approximate geolocation — general location derived from your IP address or device settings.
  • Communications — the content of emails, chat messages, web forms, text messages, and phone calls with us, which may be recorded or retained.
  • Inferences — preferences and characteristics we may derive from the information above to provide and improve our services.

3. How We Collect Information

We collect information: (a) directly from you when you complete a form, submit an application, sign a lease or agreement, or communicate with us; (b) automatically through cookies and similar technologies when you use the Site; and (c) from third parties, such as consumer reporting and tenant-screening agencies, property owners, prior landlords, employers, references, payment processors, and our software and service providers.

4. How We Use Information

We use personal information to:

  • Respond to inquiries and provide information about available properties;
  • Process and evaluate rental applications and conduct tenant screening;
  • Prepare, administer, and enforce leases and management agreements, and collect rent and other charges;
  • Provide, maintain, and improve our property management and leasing services;
  • Operate, secure, and improve the Site;
  • Communicate with you about your application, tenancy, account, or our services, including by email, phone, and text message where permitted;
  • Comply with our legal, regulatory, and licensing obligations, including those of the Washington State Department of Licensing, the Idaho real estate regulatory framework, fair-housing laws, and landlord-tenant law;
  • Detect, prevent, and address fraud, security incidents, and unlawful activity; and
  • Send marketing or informational communications, from which you may opt out at any time.

5. Cookies and Tracking Technologies

The Site uses cookies and similar technologies, which fall into three general categories: (a) essential cookies necessary for the Site to function; (b) analytics cookies (such as Google Analytics) that help us understand how the Site is used; and (c) advertising cookies (such as the Meta Pixel) that support marketing.

You can control cookies through your browser settings and through the choices described on our Your Privacy Choices page. We honor recognized browser-based opt-out signals, including the Global Privacy Control (GPC), where technically feasible.

6. Text Messaging (SMS)

If you provide your mobile telephone number and opt in, we may send you text (SMS) messages relating to your inquiry, application, tenancy, account, maintenance requests, or our services, and, only with your separate consent, promotional messages. Message frequency varies. Message and data rates may apply. You may reply STOP to opt out of text messages at any time and HELP for assistance. Consent to receive text messages is not a condition of applying for or renting a home.

We do not sell or share your mobile opt-in information or your SMS consent with third parties or affiliates for their own marketing purposes. We disclose your mobile information only to service providers that help us deliver our messaging (such as our text messaging platform), and only so they can provide those services to us.

7. How We Share and Disclose Information

We disclose personal information only as described in this Policy:

  • Service providers — companies that perform services on our behalf, such as property management software, hosting, payment processing, tenant screening, analytics, marketing, and communications providers, who are permitted to use the information only to provide services to us.
  • Property owners — for applicants and residents, we share application, tenancy, and account information with the owner of the property you are applying for or renting, consistent with our role as their managing agent.
  • Consumer reporting agencies — we exchange information with tenant-screening and consumer reporting agencies to evaluate applications, subject to the FCRA and applicable state law.
  • Professional advisors and successors — attorneys, accountants, insurers, and, in the event of a merger, acquisition, financing, or sale of assets, the party to that transaction.
  • Legal and safety — government agencies, courts, or other parties when we believe disclosure is required by law, subpoena, or legal process, or is necessary to protect the rights, property, or safety of iRE, LLC, our clients, residents, or others.

We do not sell your personal information for money, and we do not share your personal information with third parties for their own cross-context behavioral advertising.

8. Consumer Reports and Tenant Screening

If you apply for a rental, we may obtain a consumer report (including credit, rental, eviction, and criminal history) through a consumer reporting agency. Before we charge any screening fee, we will provide the disclosures required by Washington's tenant-screening law (RCW 59.18.257) or applicable Idaho law, as relevant to the property's location, including the type of information reviewed, the criteria that may result in denial, the name and address of the consumer reporting agency used, and your right to obtain a free copy of your report and to dispute its accuracy. If we take an adverse action (such as denying an application) based in whole or in part on a consumer report, we will provide the adverse action notice required by the FCRA and applicable state law.

9. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, to provide our services, and to comply with our legal, tax, accounting, licensing, and recordkeeping obligations, after which we securely delete or de-identify it. Retention periods vary based on the type of information and the applicable legal requirement.

10. Data Security and Breach Notification

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

In the event of a data breach involving personal information, we will provide notice to affected individuals and, where required, to regulators, in accordance with applicable law, including Washington's data-breach notification statutes (RCW 19.255.010 and RCW 42.56.590) and Idaho's data-breach notification law (Idaho Code §§ 28-51-104 through 28-51-107).

11. Your Privacy Choices and Rights

Neither Washington nor Idaho has enacted a comprehensive consumer-privacy statute granting residents general statutory rights to access, correct, delete, or opt out of the "sale" or "sharing" of their personal information. As a result, this Policy does not describe such statutory rights for Washington or Idaho residents. Nonetheless, as a matter of good practice, you may:

  • Access and correct — request a copy of the personal information we hold about you and ask us to correct inaccuracies;
  • Delete — ask us to delete personal information we are not required to retain for legal, contractual, or legitimate business reasons;
  • Opt out of marketing — unsubscribe from marketing emails using the link in the message, reply STOP to marketing texts, or contact us directly; and
  • Manage cookies and tracking — use the choices described in Section 5 and on our Your Privacy Choices page, including the Global Privacy Control.

To make a request, contact us using the information in Section 16. We will respond within a reasonable time and may need to verify your identity before acting on your request. Certain information, such as records we are required to keep under landlord-tenant, tax, licensing, or financial-services law, or information governed by the FCRA or the federal Gramm-Leach-Bliley Act (GLBA), may be exempt from deletion or access requests.

Washington My Health My Data Act. In the ordinary course of property management we do not seek to collect "consumer health data" as defined by Washington's My Health My Data Act. If you believe you have shared health-related information with us, you may contact us to request that it be deleted.

Residents of other states. If you reside in a U.S. state that has enacted a comprehensive consumer-privacy law and you believe it applies to your interactions with us, you may contact us using the information in Section 16, and we will evaluate and respond to your request as required by applicable law.

12. Third-Party Websites and Services

The Site may contain links to third-party websites and services, including listing platforms, payment portals, and social media. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.

13. Children's Privacy

The Site is intended for adults and is not directed to children under 16. We do not knowingly collect personal information from children under 16. If we learn that we have collected such information, we will delete it. If you believe a child has provided us personal information, please contact us.

14. Do Not Track

Some browsers offer a "Do Not Track" (DNT) signal. Because there is no common industry standard for responding to DNT signals, the Site does not currently respond to them. We do, however, honor the Global Privacy Control as described in Section 5.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate, provide additional notice. Your continued use of the Site after changes are posted constitutes acceptance of the revised Policy.
